2010 PIECES OF ROCK SWEEPSTAKES

OFFICIAL RULES

  1. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  ALL U.S. FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.
  2. HOW TO ENTER:
    1. Visit www.onlyong.com from 12:00am EST on February 2, 2010 through 11:59pm EST on February 28, 2010 and click on the “Pieces of Rock” graphic and follow submission instructions.  Each entrant will be directed to a page on the Ohio Natural Gas (“ONG”) website to participate in the 2010 Pieces of Rock Sweepstakes.  Each entrant will be required to complete an online entry form in order to have a chance to win.  Enter your first and last name, complete address, city, state, zip code, home telephone number, birth date, and valid email address, then complete the Pieces of Rock game, a three-dimensional glass pyramid presented on the ONG website.  Entrants are limited to one entry per person, per email address.  All entries must be received by 11:59pm EST on February 28, 2010.  For purposes of these Official Rules, “receipt” of an online entry will be solely determined when the www.onlyong.com web server records the entry information.  Any automated computer receipt (such as one confirming delivery of email) does not constitute actual receipt of an entry form for purposes of these Official Rules. ONG’s computer is the official time keeping device for this sweepstakes.  Use of any device to automate entry is prohibited.
    2. ONG is not responsible for entries not timely received due to difficulty accessing the Internet or ONG’s website, service outage or delays, computer difficulties or other technological glitches.
  3. ELIGIBILITY:  The sweepstakes is open to Ohio residents who reside in the Dominion East of Ohio and Vectren Delivery of Ohio service territories.  Employees of ONG, the Rock and Roll Hall of Fame and Museum, and all affiliated companies (and the immediate family members of all such employees, and all others with whom they are domiciled) are not eligible to participate or win.  The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren.  No person may win more than once or receive more than one prize for participating in this sweepstakes.
  4. PRIZE:
    1. One (1) qualified winner will receive the grand prize consisting of standard coach-class roundtrip airfare for the winner and one (1) guest to New York City on March 15, 2010, returning March 16, 2010, from any location in the 48 contiguous states of the United States and D.C., standard accommodations of one (1) room at the Waldorf Astoria New York for one (1) night on March 15, 2010, and two (2) tickets to the 2010 Rock and Roll Hall of Fame Induction Ceremony on March 15, 2010.  This prize is valued at approximately $7,000.
    2. Fifty (50) qualified winners will each receive two (2) tickets to the official Simulcast Induction Party to be held on March 15, 2010 at the Rock and Roll Hall of Fame and Museum in Cleveland, Ohio.  Each ticket is valued at approximately $6.
    3. From all qualified entries, the entrant who has the most album covers correct in the Pieces of Rock game will win the grand prize, provided that if more than one entrant has the same number of album covers correct, then one (1) winner will be selected by ONG at random from all qualified tied entries.  For the official Simulcast Induction Party tickets, ONG will select at random from all qualified entries 50 winners.  Winners will be selected and notified by ONG on or about March 1, 2010.
    4. All prizes are subject to availability, blackout dates and other restrictions/conditions.  Once hotel or air transportation has been booked, no extension, modification or substitution is permitted, except at ONG’s sole discretion.  If a guest of a winner is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless deemed to be a winner.  Each winner of a prize is solely responsible for all other unspecified costs, incidentals and expenses, including, but not limited to, any unspecified ground or air transportation, meals, gratuities, phone calls, insurance and other expenses not specifically mentioned as being included.  Other restrictions may apply.
    5. If due to circumstances beyond the control of ONG any prize-related event is delayed, rescheduled, postponed or cancelled, ONG reserves the right, but shall not be obligated, to cancel or modify the sweepstakes or award a substitute prize in its sole discretion.
  5. ODDS:  The odds of winning depend on the number of qualified entries received.
  6. WINNER NOTIFICATION AND ACCEPTANCE:
    1. Each winner may waive his or her right to receive a prize.  No entrant needs to be present to win.  No prize may be assigned or transferred.  No substitutions allowed, except that each prize is subject to availability and ONG reserves the right to substitute prizes of equal or greater value at its sole discretion.  Each winner is solely responsible for the reporting and payment of any taxes on a prize.  As a condition of receiving his or her prize, each winner will be required to provide valid government-issued photo identification and complete an affidavit of eligibility and a liability and publicity release, which must be signed and delivered prior to any delivery of a prize.  Failure to sign the affidavit or release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of ONG, result in the winner's disqualification and the forfeiture of his or her interest in a prize.  Except where prohibited, participation in the sweepstakes constitutes the winner's consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from ONG and to the inclusion of his or her name and image in any other related publications or Web sites for any commercial or promotional purpose, without limitation or additional compensation.  The winners’ names may be obtained by sending a request with self-addressed, stamped envelope to Ohio Natural Gas c/o 2010 Pieces of Rock Sweepstakes, P.O. Box 14657 Cleveland, Ohio 44114. 
    2. Winners will be contacted by ONG via telephone call.  In the event a winner cannot be contacted or fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, that winner will forfeit the prize.  After ONG has made contact with the winners, each winner will receive an official communication via email or mail on how to redeem the prize.
  7. PARTICIPATION: 
    1. Participation in the sweepstakes constitutes an agreement by each entrant to comply with these Official Rules.  ONG reserves the right to cancel or modify the sweepstakes in whole or in part at any time in its sole and absolute discretion for any or no reason. 
    2. Entrants are required to provide truthful and accurate information to ONG, and ONG will reject and delete any entry that it discovers to be false or fraudulent.  ONG will disqualify any entry from individuals who do not meet the eligibility requirements, and ONG will also delete any entry received from persons under the age of thirteen (13) in compliance with the Children’s Online Privacy Protection Act.
  8. LIMITATIONS OF LIABILITY:  By entering the sweepstakes, each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the sweepstakes but in no event attorneys' fees; and (c) under no circumstances will any entrant or other prize recipient be permitted to obtain any award for, and entrant hereby waives all rights to claims for, punitive, incidental, indirect, special or consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
  9. CONSTRUCTION:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and ONG in connection with the sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Ohio, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Ohio.  The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
  10. GENERAL RELEASE:  By accepting a prize, all winners and guests release ONG and any other promotional sponsors, including, but not limited to, the Rock and Roll Hall of Fame and Museum, and each of their respective parents, affiliated companies, shareholders, members, directors, officers, employees, representatives and agents from any and all liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the sweepstakes or with the receipt, acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or loss or destruction of property, rights of publicity or privacy, defamation, and portrayal in a false light).

  12. SPONSOR; Ohio Natural Gas P.O. Box 14657 Cleveland, Ohio 44114 is the sponsor of the sweepstakes.
  13. MISCELLANEOUS:  This promotion is sponsored by ONG whose decisions regarding the selection of winners and all other aspects of the sweepstakes shall be final and binding in all respects and upon all parties.  ONG will not be responsible for typographical, printing or other inadvertent errors in these official rules or in other sweepstakes materials.  If you have any questions regarding the sweepstakes, please contact ONG at Ohio Natural Gas c/o 2010 Pieces of Rock Sweepstakes, P.O.
